Wrongful Death Suit Against an Employer

Not all wrongful death suits are against an individual. Some are against entities such as a business or even a government agency. In some cases, the business has failed to create a safe working environment, negligently causing a worker’s death. This type of liability can include a range of incidents such as:

  • Falls
  • Electrocution
  • Being Struck
  • Being Caught In-Between

Just like a normal wrongful death suit, a suit against an employer can be filed by the individual’s surviving family, such as a spouse and children. When the surviving family members file a wrongful death suit, they are saying that the worker died because of negligence on the employer’s part, so they should be compensated for damages. These damages can include:

  • Medical Expenses (from the time of the accident until death)
  • Burial and Funeral Expenses
  • Loss of Quality of Life
  • Loss of Companionship
  • Loss of Financial Support

The family of the victim is essentially seeking compensation for the loss of the individual in their lives, including both emotional and financial loss. To win compensation for these damages, you must prove that the employer was negligent. This can be difficult without the help of a wrongful death attorney.
