An employee was killed in a vent shaft accident at the Leeville mine north of Carlin, according to confirmed reports.
The employee’s death was confirmed by Mary Korpi, spokeswoman for Newmont Mining Corp. The employee, who has not been identified, was employed by Cementation Inc. The death of the contract worker is currently being investigated by both state and federal officials, and the company is cooperating with the U.S. Mine Safety and Health Administration and the Nevada Mine Inspector’s Office. The cause of the accident has yet to be determined.
Wrongful Death Suit Against an Employer
Not all wrongful death suits are against an individual. Some are against entities such as a business or even a government agency. In some cases, the business has failed to create a safe working environment, negligently causing a worker’s death. This type of liability can include a range of incidents such as:
- Being Struck
- Being Caught In-Between
Just like a normal wrongful death suit, a suit against an employer can be filed by the individual’s surviving family, such as a spouse and children. When the surviving family members file a wrongful death suit, they are saying that the worker died because of negligence on the employer’s part, so they should be compensated for damages. These damages can include:
- Medical Expenses (from the time of the accident until death)
- Burial and Funeral Expenses
- Loss of Quality of Life
- Loss of Companionship
- Loss of Financial Support
The family of the victim is essentially seeking compensation for the loss of the individual in their lives, including both emotional and financial loss. To win compensation for these damages, you must prove that the employer was negligent. This can be difficult without the help of a wrongful death attorney.
