Posted by: Jack Bernstein

According to reports, a Henderson man has been killed in a workplace accident involving a crane. Witnesses and investigators state that Judge W. Lightfoot, 63, was pinned under a 75-ton crane that he had been operating on a job in San Bernardino County, California. Through rescue teams responded immediately, Lightfoot died from his injuries.

Jason Baker, Lightfoot’s son, stated that his father was a master crane operator who had more than 40 years of experience. He had participated in the construction of many iconic properties along the famous Las Vegas strip. Baker stated, “My dad is known for being one of the best crane operators and the best at what he does, so when something like that happened today, it’s still unbelievable.” The California Division of Occupational Safety and Health has launched an investigation into the accident.

Workplace Accidents and Wrongful Death

Each year many workers fall victim to accidents at the workplace. This is especially common in construction jobs. When an individual is killed in a workplace accident, the surviving family may be entitled to payment of damages. These damages could include medical expenses, pain and suffering, lost wages, lost future earnings and even loss of companionship.

However, in order to pursue a wrongful death case, the victim’s family must prove negligence. This means that someone was acting negligently which caused the accident, or negligence occurred through other means like an unsafe working environment.

For example, if a machine operator is injured or killed because he or she was not properly trained in using the equipment, the employer could be found negligent because it was the company’s responsibility to see that all employees were given adequate training. If the accident is caused by faulty or defective equipment, then the manufacturer of that equipment could be held responsible. Your personal injury attorney can help you determine who is negligent in your specific case.
