How is a Wrongful Death Suit Different from a Personal Injury Suit?

Posted by: Jack Bernstein

When an individual is killed in an incident that was caused by the negligence of another person, the surviving family members may have grounds for a wrongful death suit. Wrongful death suits are similar to personal injury suits. The difference is that wrongful death suits are filed on behalf of a deceased victim while personal injury suits are filed on behalf of a victim who sustained injuries but survived.

What Type of Compensation Can I Seek?

Some of the damages you can seek in a wrongful death suit are similar to those in a personal injury suit. However, there are a few damages you can only seek in a wrongful death suit. If you are a surviving spouse, child or other dependent of a person killed by a negligent individual’s actions, you may seek compensation for a range of damages including:

  • Medical expenses from the moment of the accident to death
  • Funeral and burial expenses
  • Pain and suffering
  • Loss of companionship
  • Loss of income or inheritance

The wrongful death and personal injury attorneys at Bernstein & Poisson in Las Vegas have represented grieving families for 29 years. We are always inspired by the ability of surviving family members to come together and work through this confusing and frightening time. Working together, surviving family and friends create a constructive environment in which to heal. As the attorneys representing your family, we apply this same focus and approach to each wrongful death case we handle.

While these families inspire us by rallying together, that does not mean that they should not take on a wrongful death case on their own. There are many insurance adjusters and/or defense attorneys who may not show them the respect and dignity they should. In fact, insurance adjusters and others often try to avoid paying family members compensation for their losses and may even try to convince them that they are not entitled to payment.

Instead of dealing with insurance companies alone, the surviving family members should turn to the team of attorneys at Bernstein & Poisson, who will hold the family’s best interest at heart. We will work to minimize the financial exposure you face and aggressively represent you to give you the best chance at collecting the maximum amount of compensation. Grieving families without any legal background are frankly not often in a position to deal with these situations properly. If you have lost a loved one due to another’s negligence, give the compassionate and understanding team of lawyers at Bernstein & Poisson a call today.
