Boating Accidents and Personal Injury
While boating is a popular pastime, it can result in serious injury and even death when someone acts in a negligent manner. If you were injured in a boating accident, you may have grounds for seeking compensation through a personal injury suit. However, to win your suit you must prove that your injuries were the result of another person’s negligence.
Boating accidents typically involve one or more of the following:
- One boat hitting another boat
- One boat hitting another boat’s wake
- One boat hitting a wave
- One boat hitting a submerged object
In some of these cases, the victims may be able to seek compensation if the driver of the boat was acting in a negligent way. For example, if the driver of the boat was impaired by alcohol or drugs, he or she would not only be breaking the law but could also be considered negligent in the event of a crash.
You may also have grounds for seeking compensation if the boat you were on did not have proper safety items like life vests. The law requires boat owners to provide occupants with the proper safety equipment to prevent serious injury and even death. When they fail to do this and an injury occurs, they may be held responsible.
Like a car crash, the victims of a boat crash can seek compensation for injuries and related expenses. Common damages claimed in a boat crash include lost earnings and lost earning capacity, medical bills and pain and suffering. If a loved one is killed in a boating accident, the surviving family members may also have grounds to file a wrongful death suit in some situations.
