boulder highway pedestrian killedA Las Vegas man has died after being struck by a car in Henderson, Nevada. Authorities report that John R. Murphy, 34, was crossing Boulder Highway on foot when he was struck by a motor vehicle driven by a 26-year-old.

The driver of the automobile voluntarily took a blood test. Investigators do not believe that drugs or alcohol were factors in the accident. The driver was not injured in the accident.

According to authorities, Murphy was in the crosswalk, but the red “don’t walk” signal was on at the time of impact.

This is the second traffic-related death in Henderson this year, according to officials.

Wrongful Death Lawsuits in Motor Vehicle Accidents

Thousands of pedestrians are killed each year in motor vehicle accidents. According to recent statistics from the Centers for Disease Control, Clark County had the highest traffic death rate in the state, with pedestrians accounting for about 16 percent of all vehicle accident deaths. Pedestrians are statistically more likely to be killed in a crash than the occupants of a motor vehicle.

When someone is killed by a negligent driver, the family of the victim may consider filing a wrongful death lawsuit. Compensation usually consists of all expenses related to the death and, in some cases, punitive damages.

However, sometimes the driver is not the only one at fault. A wrongful death lawsuit may also be filed against a company or public agency for failure to properly maintain signage, crosswalks, parking lots, roads and traffic signals if this neglect contributed to the death of the pedestrian.

Compensation sought in wrongful death lawsuits may include the following:

  • Medical and funeral expenses
  • Loss of any earnings the victim would have made up until the time of retirement.
  • Other monetary losses such as retirement income, life insurance, or even loss of medical coverage.
  • Pain and suffering
  • Punitive damages in some cases
