A pedestrian suffered critical injuries in a Las Vegas crash, according to recent reports. The unidentified male victim was taken to Sunrise Hospital with critical injuries after he was hit by a vehicle headed south on Maryland Parkway near Oakey Boulevard. He did not appear to have been in the crosswalk when the accident took place. The vehicle fled the scene and the driver has not been apprehended. There is no word on the prognosis of the victim or any leads on locating the driver.
Am I Entitled To Damages if I Was Not In A Crosswalk?
Many people have the mistaken impression that pedestrians who are hit outside a crosswalk have no right to compensation from the drivers who hit them. This is generally a false assumption, as liability may have little or nothing to do with the legality of an action. While the law states that pedestrians should use the crosswalk, it also states that drivers have the duty of care to prevent collisions with pedestrians by using due caution to avoid them.
Additionally, pedestrians are at a distinct disadvantage in a collision with a vehicle. Therefore, the law places more responsibility on the driver of a car to avoid these types of accidents than on pedestrians, although the law is clear that pedestrians are also expected to use due caution.
The result of all of this is that a pedestrian may be entitled to collect damages from a driver even if he or she was not strictly within the law when hit by a car. While it is a good idea to always use crosswalks for safety purposes, that does not relieve the driver of the responsibility of avoiding an accident with a pedestrian by using due caution. If a driver is speeding or behaving recklessly, he or she may be liable for damages.
