Press Release: The Las Vegas Wrongful Death Lawyers at Bernstein & Poisson File Lawsuit against Care Facility

Specifically, this Nevada wrongful death lawsuit was filed in the District Court of Clark County, Nevada and it was assigned a case number of A626810. The defendant in the case is College Park Rehabilitation Center and the plaintiff is the administrator of the estate of the person who was killed in the incident that led to the filing of this lawsuit.

The court documents allege that the decedent was admitted to the assisted living facility because she was a fall risk and she needed to be carefully watched. The documents state that the facility acknowledged that the decedent was a fall risk and that oversight was necessary for this reason. Unfortunately, on October 25, 2010, the decedent was rushed to a nearby hospital and pronounced dead after falling out of her allegedly unsecured bed.

In addition to the complaint, the court documents contained an exhibit that involved a written statement from a medical expert that stated that, in her opinion, the medical records for the decedent indicated that the defendant facility had been negligent by failing to make use of the side guardrails that were available on the decedent’s bed. The defendant facility then filed documents that denied these allegations.
