Crime and Punishment and Personal Injury

The difference between a personal injury lawsuit and a criminal action can be difficult to understand. If you are injured in an accident that takes place during the commission of a crime, then it is likely that you may have a civil complaint against the person who hurt you, whether or not that person is charged with or convicted of a crime.

Criminal law is different from civil law. In criminal cases, the prosecutor is acting on behalf of the people of the state, not an individual. Therefore, criminal cases are not designed to compensate victims for their losses but instead to hold criminals accountable to society for their behavior. Civil cases, on the other hand, are filed by individuals who have been harmed by the actions of someone else.

It is very important for those who have been injured by a criminal’s actions to understand the difference between these two types of cases and to take the proper action to secure a judgment to pay for medical bills, pain and suffering, lost wages and other costs in civil court, no matter what happens in criminal court.

How Can In Be Sure I Am Compensated For My Injuries?

For most people who are injured by a criminal’s actions, the most certain way of recovering compensation is through a personal injury lawsuit. This lawsuit will probably name the criminal as a defendant, but may also name others such as the city or county, the police or others who may have been involved in the accident.
