Two Injuries and One Death in Convention Center Crash

Recent reports indicate that an accident that occurred on Convention Center Drive near Paradise Road caused two injuries and one death. Witnesses said that the Lincoln Navigator was traveling east at a high rate of speed in the westbound lanes of Paradise Road when the driver rode up onto the sidewalk and crashed into a large support column.

The driver and the front-seat passenger, both of whom were 21, suffered serious injuries and were taken to an area hospital. The 58-year-old male passenger in the backseat later died at the hospital from his injuries.

Police believe that a road-rage incident may have preceded the crash.

Liability When The Driver Is Injured

It is possible for a driver to be badly injured in a crash and still be liable for the lesser injuries of others. In fact, in many serious crashes, the driver who is at fault is killed or severely injured. However, that does not remove his or her liability for causing the crash. If the driver does not survive, his or her estate may be liable for damages to the victims.

The test for liability is whether the driver was negligent. If so, the driver may be held accountable by being made to pay for the medical bills and other expenses incurred by victims in the crash. In some cases, two drivers share liability in an accident. In that case, both of the drivers may be held liable, and the liability of one may be used to offset damages owed to the other. For example, if two drivers are both at fault in a crash, a jury may determine that Driver A is 30 percent responsible and Driver B is 70 percent responsible. In that case, Driver A would be entitled to reduced damages from Driver B. This is known as comparative liability and allows even those who may be partially at fault for an accident to collect compensation.
