Wrongful Death: One Killed in a Two-Vehicle Crash

wrongful_deathA tragic crash took the life of a 16-year-old girl recently when an 18-year-old lost control of his vehicle, according to reports. Katheryn Mushok, 16, was killed when Matthew Sellers, 18, hit a curb and lost control while driving eastbound on Garden of the Gods. His vehicle traveled across three lanes of traffic and was hit in the right passenger side, then hit by the vehicle in which Mushok was riding.

Sellers was cited for careless driving resulting in death. The driver of the car in which Mushok was a passenger was not cited.

Wrongful Death Cases

In order to have grounds for a wrongful death case, a family member must show that the death of a loved one was caused by someone else’s negligence and would not have occurred except for that person’s actions. Only certain people are entitled to file a wrongful death lawsuit. In Nevada, those people include “heirs and personal representatives” of the deceased. This can be an immediate family member such as a child, spouse or parent, a legal dependent or a representative of the deceased person’s estate.

Wrongful death lawsuits often claim damages such as loss of future income and support. In the case of the death of a child, this may not be appropriate. However, a child’s wrongful death lawsuit may include loss of companionship as well as pain and suffering.
